What types of custody are awarded in Oklahoma?
Joint Custody - Each parent has input regarding the best interests of their children and has a right to participate in the decision-making process and time with the child. The parties agree to important decisions affecting the children and follow a joint custody plan ordered by the Court.
Sole Custody - Decisions involving the minor children should be discussed between the parties; however, one parent will have the final decision-making authority if they possess sole custody of a child.
Physical Custody - Involves the time a parent’s child will reside with him or her. Physical custody may be granted solely to one parent. If the child resides with one parent more often than the other, the home of the parent the child resides with more frequently will generally be considered the primary residence. The other parent will normally be awarded visitation with the children.
Legal Custody - Legal custody involves the decision-making process of a child. If a parent has sole custody, they have the right to make legal decisions regarding the child. These decisions may include education, healthcare, and matters of religious upbringing.

FAQs
-
Legal custody refers to the right to make important decisions about the child’s upbringing, including education, healthcare, and religious instruction. Physical custody refers to where the child lives and the day-to-day care of the child. Both types of custody can be either sole or joint.
-
Yes, a custody or visitation order can be modified if there has been a significant change in circumstances since the original order was issued. The parent seeking the modification must demonstrate that the change is in the best interest of the child.
-
If the other parent is not complying with the visitation order, you can file a motion for enforcement with the court. The court may take various actions, including holding the non-compliant parent in contempt, modifying the visitation order, or imposing sanctions.
-
While the court may consider the wishes of a child who has reached 12 years of age, the child’s preference is only one factor in the overall custody determination. The final decision is based on what the court believes is in the child’s best interest.
-
If a custodial parent wants to relocate with the child over 75 miles, they must notify the other parent and the court. The non-relocating parent can object to the move within 30 days, and the court will determine whether the relocation is in the best interest of the child.
